2. Acceptance of the Terms
Accessing the platform implies full and unreserved acceptance of these Terms. If you do not accept these conditions, please do not use the platform.
3. Services offered
QronoPlay is a SaaS platform that enables businesses to create and manage marketing campaigns via QR codes, including instant-win games, lead capture and GDPR consent management.
- Creation of gamified marketing campaigns
- Generation of secure QR codes
- Collection and management of entries
- GDPR-compliant data exports
- Real-time statistics and analytics
4. Registration and user account
Accessing the platform's features requires the creation of an account. You undertake to provide accurate information and to keep it up to date.
Account responsibility: You are responsible for the confidentiality of your login credentials. Any activity carried out from your account is presumed to have been carried out by you.
5. Subscriptions and pricing
Use of the platform is subject to a monthly or annual subscription depending on the selected plan (Starter, Pro, Business, Enterprise).
- Trial period: 7 days free, no credit card required
- Billing: Monthly, automatic via direct debit
- Cancellation: Possible at any time from the interface
- Refunds: No refund for months already started
6. Intellectual property
All elements of the platform (interface, source code, graphics, logos) are the exclusive property of QronoPlay and are protected by copyright.
License of use: QronoPlay grants you a non-exclusive, non-transferable and revocable license to use the platform in connection with your business.
Your content: You retain all rights in the content you create (campaigns, visuals, copy). You grant QronoPlay a license to use such content as necessary to provide the service.
7. Personal data
QronoPlay is committed to protecting personal data in accordance with the GDPR. For more information, please refer to our privacy policy.
Data responsibility: You are responsible for the processing of personal data collected through your campaigns. QronoPlay acts as a processor. The applicable data processing agreement under Article 28 GDPR is available at /dpa.
8. Acceptable use
You undertake not to:
- Use the platform for unlawful or fraudulent purposes
- Disseminate offensive, discriminatory or indecent content
- Attempt to circumvent security measures
- Overload the infrastructure with abusive requests
- Resell or sublicense access to the platform
9. Availability and maintenance
QronoPlay endeavors to ensure 24/7 availability but does not guarantee uninterrupted access. Interruptions may occur for maintenance or technical reasons.
SLA: For Business and Enterprise plans, a specific Service Level Agreement is defined contractually.
10. Limitation of liability
QronoPlay shall not be held liable for indirect damages resulting from the use or inability to use the platform (loss of data, loss of profit, business interruption).
QronoPlay's liability is limited to the amount paid by the customer during the past 12 months.
11. Suspension and termination
QronoPlay reserves the right to suspend or terminate an account in the event of:
- Non-payment of invoices
- Breach of these Terms
- Fraudulent or abusive use
- Request from competent authorities
In the event of termination, you have 30 days to export your data before final deletion.
12. Changes to the Terms
QronoPlay reserves the right to modify these Terms at any time. Users will be notified by email 15 days before the changes take effect.
Continued use of the platform after modification constitutes acceptance of the new Terms.
13. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or performance shall fall within the exclusive jurisdiction of the courts of Cherbourg-en-Cotentin, France.
